One incident set up to be extremely deniable is one thing. They do not want EE violations to become a regular method of waging war.

Exactly how would a couple of pods worth of the SLN'S missiles "going off target" and slamming into the planet cause EE violations to become regular? Especially if the Admeral in charge is recalled and tried for mass murder?

Beowulf would be the ultimate opportunity for the MAlign to open that can of worms where the SLN can become scapegoats and patsies when everyone knows that they detest the treasonous actions of Beowulf and would love to retaliate -- a fact that cannot be impugned. And the MAlign can kill two big birds with one stone by implicating the SLN -- further splintering it while simultaneously achieving a long harbored notion of revenge against Beowulf. The only negative is that the MAlign wouldn't be able to look the Beowulfans in the eye -- to serve the dish cold. The entire backdrop of drama centering around Beowulf and the political triangle with the League and the Star Empire is the perfect stage. Executed flawlessly and spun just right would cast just enough of a shadow of doubt of the identity of the perpetrators. Except to the GA — but who believes those loons enough for them to substantially repudiate the facts anyway.

No one believes that the MAlign would use EE strikes as a common practice, but I simply see a one time charge of millions of lives to be nothing more than a stepped up version of the space station tragedy, Gisele, to the MA.

Son, your mother says I have to hang you. Personally I don't think this is a capital offense. But if I don't hang you, she's gonna hang me and frankly, I'm not the one in trouble. —cthia's father. Incident in ? Axiom of Common Sense

Besides, why does it have to be a conventional EE strike? Any entity that can engineer stealthy nanite weaponry can just as easily manufacture stealthy biological warfare on a scale that kills millions with no fingerprint -- how to get away with the perfect mass murder.

Aside:
The pilot episode of Supergirl airs in less than 35 minutes (EST) now. Y'all know how I love strong female characters. Don't forget to get your Supergirl on tonight.

If you want to get particularly inventive and nasty to layer in camouflage in causing a disaster on Beowulf, you could work-up a bio-weapon based on Beowulfian medical research and have it "escape" from a governmental research lab in conjunction with any military attack on Beowulf.
Recall that Albrect's wife is dealing with weaponizing nanites. If you start with something that is already part of Beowulfian medical research and based in making cellular changes to address a specific problem, what is to say that it can't be converted into something that makes slghlty wrong changes that cause short term degenerative changes but lets the host human survive (without exhibiting the onset of the problem) until AFTER the nannies or virus have passed the point where the hosts are infective and spreading the plague into the environment.
That would provide several tags on the plague that identify it as a Beowulf creation. You can also plant it somewhere that would make it appear that it gets out of a lab near your EE event site before the site is significantly damaged. You probably want to really destroy the labs data along with it's people except that it already well known for the research into the same basic type of "medical"variation.
